Adult-Use Cannabis Businesses Allowed in Roselle

cannabis DispensaryA prohibition of all adult-use cannabis business establishments within the Village was originally enacted by the Village Board in December 2019, shortly before the Cannabis Regulation and Tax Act came into effect in Illinois. The purpose of the prohibition was to allow for thorough study on the issue before allowing these types of businesses in Roselle.

Following voter approval in an advisory referendum, public hearings, a recommendation from the Planning and Zoning Commission, and extensive Village Board discussion, the Village Board passed an ordinance in August 2021 allowing both dispensaries and cannabis cultivation businesses as a special use in certain zoning districts in Roselle. Additionally, the Village Board passed an ordinance imposing the maximum tax of 3% on the sale of cannabis at dispensaries.  In conjunction with the regular 1% sales tax remitted to the Village, cannabis sales will result in 4% sales tax being remitted to the Village.

In October 2022, the Village was approached by licensed operators of an adult-use cannabis business interested in opening a dispensary in Roselle. The Village's Planning and Zoning Commission will consider the petition for the dispensary to be located at 1350 W. Lake St. in a B-5 Business District, an allowable special use for that location, during a public hearing at Village Hall on November 1, 2022, starting at 7:00 p.m. This meeting is open to the public, and will be streamed on the Village's YouTube channel.

The Planning and Zoning Commission will make a recommendation on the petition to the Village Board, which will make the final decision. The Village Board is expected to vote on the petition during their regularly scheduled board meeting on November 14, 2022.

Additional Consideration: Adult-Use Cannabis in DuPage County

On October 25, 2022 the DuPage County Board approved text amendments to its Zoning Ordinance that would permit various adult-use cannabis establishments within the unincorporated portions of the County. Specifically, the amendments would permit adult-use cannabis dispensaries on various properties along Lake Street in unincorporated Roselle. Additional details are available here.
